“The king must die: challenging and defending capacity” – an intriguing title for a fascinating discussion on some of the most complex and sensitive issues arising in private client and family law.
Stella Strati, Partner and Head of Corporate and Private Client at Patrikios Legal, participated as a speaker at the IBA Annual Conference 2026 in Copenhagen on 7 October, contributing to a session organised by the IBA Family Law Committee, with the support of the Private Client Tax Committee.
The session explored the challenging questions surrounding legal capacity in a range of contexts, including the capacity to make a will or trust, to marry, to consent to sex and to act as a trustee. The discussion also examined the impact of divorce and remarriage on estate planning, as well as concerns surrounding predatory behaviour in later-life marriages and the legal options available to protect vulnerable individuals.
Drawing on her experience in private client, corporate and succession-related matters, Stella contributed to a discussion that highlighted the complexities that can arise when questions of capacity intersect with family relationships, wealth and estate planning, particularly in cross-border situations.
The session brought together practitioners from different jurisdictions and provided an opportunity to exchange perspectives on how these sensitive issues are approached across legal systems.
Stella’s participation reflects her active engagement with the international private client and family law community and further strengthens Patrikios Legal’s presence at leading international legal forums.
